Allegedly Drunk Driver Becomes Combative With Officers During Stop In Westchester, Police Say

An allegedly drunk driver who fell asleep behind the wheel became combative with officers attempting to take him into custody in Westchester, police said.

An officer from the Scarsdale Police Department on patrol shortly after 11:30 p.m. on Thursday, Sept. 19, spotted a 2007 Toyota Land Cruiser parked in the middle of Old Lyme Road with the engine running.

The responding officer approached the vehicle and the found the driver, Manhattan resident Felix Davey, 30, sitting in the driver’s seat, asleep. When the officer attempted to wake him, Davey was not stirred until the officer opened the driver’s side door.

According to the officer, Davey had the strong odor of alcohol on his breath and he failed to respond to basic questions coherently. The officer reached into the vehicle and was able to shut down the vehicle, though he failed to remove the key from the ignition.

When asked to step out of the car due to his level of intoxication, and to “ensure he would not attempt to drive away and put himself or others in danger.” At that point, Davey told the officer “I don’t want to (expletive) you),” while his eyes appeared to be closed.

Police said that Davey proceeded to step out of the Toyota and re-entered. At that point, he began to move around and failed to comply with instructions from the officer when asked to show him his hands. The officer then called for backup.

The officer said that he attempted to remove Davey from the vehicle, at which point he became combative and non-compliant. As he was attempting to remove him from the vehicle, the officer was dragged partially into the car, at which point, a second officer arrived at the scene, struggling with Davey.

According to the initial officer, “(Davey) then fell to the ground, ripping a large hole in my pants and caused swelling, bleeding and substantial pain. During the course of the struggle, I also injured my lower back.”

Once the struggle went to the ground, officers were able to gain control and handcuffed Davey.

Davey was arrested and charged with driving while intoxicated, operation of a motor vehicle with a blood alcohol content greater than .08 percent and obstruction of justice, all misdemeanors. He was also charged with a felony count of assault with intent to cause physical injury to a police officer.

Following his arraignment in Scarsdale Village Court, Davey was remanded to the Westchester County Jail in lieu of $2,500 cash bail or $5,000 bond. No return court date has been announced.
